أن القيمة الدستورية لمبدأ التنمية المستدامة لا تقتصر على الجانب البيئي، بل تمتد لتشمل منظومة الحقوق الاقتصادية والاجتماعية التي تُشكّل مضمون العدالة الاجتماعية. وأن الدستور العراقي لعام 2005 قد تضمّن نصوصاً ذات طابع تنموي اجتماعي تصلح أساساً للاستدلال بها لدعم مبدأ التنمية المستدامة، وإن جاءت في غير نصٍّ صريح يُكرّس المبدأ بوصفه حقاً دستورياً مستقلاً. كما أن العدالة الاجتماعية باتت قيمةً دستوريةً تستدعي حمايةً قضائيةً فاعلة، غير أن إعمال هذه الحماية يبقى رهيناً بإرادة المشرع والقضاء الدستوري.
