يتناول هذا البحث دراسة النطاق الشخصي لإشكالات ومنازعات التنفيذ الجبري في ضوء أحكام قانون التنفيذ العراقي وقانون المرافعات المدنية والتجارية المصري. ويسلط الضوء على تحديد المراكز القانونية لأطراف الخصومة التنفيذية المباشرة (الدائن والمدين) من حيث توافر شروط المصلحة والصفة والأهلية، وبيان المركز القانوني للغير وحالات تدخله لحماية أمواله. كما يعالج البحث الدور القانوني والرقابي للجهات المختصة بالفصل في هذه المنازعات، متمثلة بالمنفذ العدل ومحكمة الاستئناف بصفتها التمييزية في العراق، ومقارنتها باختصاصات قاضي التنفيذ والمحكمة الابتدائية بهيئتها الاستئنافية في مصر، وصولاً إلى وضع معالجات تسهم في تيسير إجراءات التقاضي واستقرار المعاملات التنفيذية.
