الملخص

الفكرة القانونية السائدة في الدستور هي الفكرة التي لها الغلبة بين الأفراد فيما يتعلق بشكل الدولة وطبيعة نظام الحكم وتنظيم اختصاصات السلطات وحقوق الأفراد وحرياتهم. ومن ثم فهي تمثل الأساس الفلسفي لنظام الحكم والإطار القانوني لكافة النشاطات التي تباشرها السلطات العامة في الدولة، ولهذا يُطلق عليها أحياناً بالفكرة الحاكمة، وأحياناً أخرى فكرة القانون المقبولة شرعاً في الدولة. والدستور يقوم بتحديد تلك الفكرة القانونية السائدة لدى أفراد المجتمع السياسي-صراحة أو ضمناً- والتي ينبغي معها أن تتطابق معها كل التصرفات الصادرة عن سلطات الدولة المختلفة، فعليها يُبنى النظام القانوني للدولة، ومن هنا تستمد القواعد الدستورية أهميتها وتفوقها من كونها انعكاساً لتلك الفكرة. واذا كانت تلك الفكرة السائدة تتعلق برغبات وطموحات أفراد المجتمع السياسي بشأن النظام السياسي القانوني الأساسي للدولة، فإنها إذن غير ثابتة، بل متغيرة وقابلة للتطور، وذلك لتعاقب الأجيال وتغير الظروف بما ينسجم مع الحقوق والحريات المعترف بها في العالم المتحضر.
