الإشكاليات القانونية في منح التعويضات المدنية للمتضررين : الحلول والمقترحات (القانون رقم 2 لسنة 2016 أنموذجاً)

إن الغاية من تشريع القانون رقم (2) لسنة 2016 المعدل، بعده من القوانيّن العدالة الانتقالية هو توفير المعالجات اللازمة من خلال تقرير التعويضات المادية والمعنوية والامتيازات الأخرى، بغيةً جبر الأضرار أو التخفيف من حدتها، جراء جرائم القتل التي ارتكبتها النظام البائد وما ارتكبتها عصابات داعش الإرهابية، مما نتج عنها الحاق أضرار جسيمة بذويهم _ذوو الشهداء_، بعده شريحة كبيرة في المجتمع العراقي.
الا انه في الواقع العملي لا يخلو تطبيق أحكام هذا القانون من إشكاليات قانونية، سواء المتعلقة باجراءات الشمول بهذا القانون والفئات المتضررة المستحقة للحقوق التعويضية والامتيازات هذا من جهة ومن جهة أخرى توجد معوقات في منح بعض التعويضات والامتيازات لهذه الفئة نتيجة غموض وقصور بعض النصوص القانونية المقررة لهذه الحقوق.
لذا تم تسليط الضوء في دراستنا على هذه الإشكاليات ووضع الحلول القانونية اللازمة سواء بتعديل بعض النصوص القانونية أو اعطاء تحليل قانوني يتوافق ويستقيم مع اهداف هذا القانون في سبيل اعطاء الحقوق للمستحقين تحقيقاً لإرادة المشرع من وراء سن هذا القانون.
