العقوبات البديلة واثرها في الحد من أنتشار الأوبئة((دراسه مقارنه))

العقوبات البديلة أثبتت جدواها كوسيلة فاعلة للوقاية من السلبيات المترتبة على عقوبة السجن، فقد أخذت دول عديدة بأسلوب وقف النطق بالعقوبة حيث لجأ إليه القضاة في الحالات التي كان الشك يساورهم في قيمة أدلة الإثبات المستند عليها في الإدانة وخاصة في الجرائم البسيطة، حيث أصبح هذا الأسلوب نظاماً عقابياً يستخدم كبديل للعقوبات السالبة للحرية، ، وقد توسع هذا الأسلوب وأخذت به كثير من الدول المتقدمة والنامية ، ويعد العمل في المجتمع كمظهر من مظاهر تقديم الخدمات الاجتماعية، وكبديل للإيداع في السجن، فضلاً انها تهدف إلى إحداث تحولات إيجابية في سلوك المذنبين أو الجناة من خلال برامج تأهيلية، ووسائل إصلاحية بعيدة عن أسوار السجن، ذات طابع علمي تتناسب مع شخصية الجريمة وجسامتها والمجرم، وبالمقابل تجنيب انتشار الأوبئة المعدية وخاصة إذا ما كانت فتاكة مثل الجوائح التي تشكل مصدر قلق للصحة العامة خصوصاً في بيئة السجون، إذ إنه بسبب التواجد الكثيف للأشخاص في الأماكن الضيقة يمكن إن تنتشر هذه الأوبئة بسرعة فتاكة بين النزلاء، كما وإن منظمة الصحة العالمية أكدت على إنه من المرجح إن جهود السيطرة على الأوبئة يمكن إن تفشل حتى في حالة اتخاذ تدابير صارمة داخل مؤسسات السجون ومراكز الاحتجاز. وخلصت هذه الدراسة إلى دعوة المشرع العراقي بتطبيق العقوبات البديلة في ظل تزايد الرغبة في معالجة جرائم البسيطة وكبديل عن العقوبات السالبة للحرية، وضرورة تعديل قانون أصول المحاكمات الجزائية رقم ( 23 ) لسنة 1971المعدل بما يجيز استخدام العقوبات البديلة.
