جريمة امتناع الموظف او المكلف بخدمة عامة عن تنفيذ الاحكام القضائية

تعد الجريمة موضوع البحث احد صور "جرائم الفساد الاداري" والتي انتشرت حالياً، وبشكل كبير مقارنة بالعصور السالفة، وهذا يرجع لأهمية الوظيفة في الوقت الحالي، وضعف التنظيم القانوني، لمثل هذه الجرائم خاصة من حيث: الجزاء الجنائي اذ وان كان عنصر التجريم موجود الا انه ضعف الجزاء الجنائي قد يسبب زيادة نسبة ارتكاب مثل هذه الجرائم، او جرائم "الفساد الاداري" الأخرى، وهذا ما يدفعنا بالبحث في هذه الجريمة والوقوف على مفهومها، ودراستها، وعليه سنقسم هذا البحث الى مطلبين: نبحث في المطلب الاول في التعريف بجريمة امتناع المُوَظَّف، او المُكَلَّف بخدمة عن تنفيذ الأحكَام القضائية، اما المطلب الثاني سنخصصه لبيان التنظيم القانوني للجريمة بوصفها احد صور "الفساد الاداري" ثم ننهي البحث بخاتمة تتضمن اهم ما توصلنا اليه من نتائج، ومقترحات.
