تسعى السياسة الجنائية الوقائية في العراق إلى مواجهة تعاطي المخدرات من خلال الوقاية والرقابة الصارمة على المواد المخدرة، بدءاً من تنظيم إنتاجها وتصنيعها وتصديرها، وصولاً إلى مراقبة تداولها داخلياً. ويقوم القانون رقم 50 لسنة 2017 بتحديد الأشخاص المخوّلين قانونياً للتعامل مع هذه المواد، وهم الأطباء والصيادلة المجازون، مع وضع ضوابط صارمة على وصف وصرف المواد المخدرة، بما يشمل تحديد الكميات المسموح بها ونظام البطاقات الخاصة بالمرضى. كما يشمل النظام الرقابي التفتيش المؤسسي ومراجعة السجلات لضمان الالتزام بالقوانين ومنع الانحراف عن الغرض القانوني. ويعكس هذا الإطار القانوني فلسفة قائمة على أن المشروعية مرتبطة بالغاية والالتزام بالإجراءات الوقائية والتنظيمية، مما يحقق حماية المجتمع من انتشار المخدرات.
