شهد العالم في العقود الأخيرة تطوراً ملحوظاً في صيغ الاستثمار، حيث اتسمت هذه الصيغ بالطابع العملي والتنظيم القانوني الدقيق من خلال عقود متينة تحدد حقوق والتزامات الأطراف بوضوح. ويُعد عقد استثمار النفط الخام من أبرز هذه العقود لما له من أهمية اقتصادية كبرى في تنشيط القطاع النفطي، لاسيما مع تنامي الطلب العالمي على المشتقات النفطية وعدم قدرة المصافي الحكومية على تلبية هذا الطلب. ومن هنا برزت الحاجة إلى دراسة الإطار القانوني لعقد استثمار النفط الخام وبيان طبيعته وأحكامه.
