يتناول هذا البحث مسألة حماية الهوية الثقافية في قضايا اللجوء والهجرة، بوصفها حقًا إنسانيًا يرتبط بكرامة الفرد وخصوصيته. ويسعى إلى بيان الدور الذي يمكن أن يؤديه القضاء، سواء الوطني أو الدولي، في ضمان احترام هذا الحق أثناء نظر النزاعات المتعلقة باللاجئين والمهاجرين. كما يناقش التحدي القائم بين متطلبات الأمن من جهة، وضرورة احترام التنوع الثقافي من جهة أخرى، مؤكدًا أهمية أن يتبنى القضاء مقاربة إنسانية توازن بين هذين البعدين وتكرّس مبدأ العدالة الثقافية، كما تناول هذا البحث العديد من الاشكاليات المتعلقة بالنقص التشريعي وصعوبة الاثبات وتنفيذ الاحكام القضائية الخاص بحماية حقوق الاجئين والمهاجرين، من خلال تقديم مقترحات تشريعية وقضائية تسهم في الحفاظ على الهوية الثقافية.
